Brand Details:

XBert Tip: A brand is the company or entity that sends messages to consumers, whereas a campaign is a set of information used to determine the use case and purpose of the messages sent.

  • Ensure your brand name, EIN, and business address match your EIN or tax documentation.
  • Include a website in your brand registration. The domain should match the Brand Support Email Address.
  • Sole proprietorships must include a wireless mobile phone number that can receive text messages.

Message Flow/Call to Action:

XBert Tip: Think of how recipients of your text messages via your campaign will consent to receive these messages. In other words, how is recipient opt-in consent obtained? The call-to-action must be explicitly clear and inform the consumer about the nature of the program.

 

XBert Tip: If you utilize a webform to obtain customer consent, it will need to be an optional opt-in on the form. To not force SMS opt-in, the consumer should be able to submit the form without checking the box to opt-in to text messages.

Campaign Description:

  • Who is SMS used between?

     

  • Who initiates SMS?

     

  • Important example topics (Scheduling, follow-ups, conversational small talk, etc.)

     

  • What kind of content is being sent?

     

XBert Tip: 

  • The campaign description summarizes the purpose of sending the SMS. This should be a clear and concise description of how an end user signs up to receive messages from your brand. This may seem similar to the Message Flow/Call to Action, but the Campaign Description should have more detail on how your company is using this messaging campaign.

     

  • There is a minimum character limit here. Don’t be shy with the description, and don’t use general statements. “General texting between customers and employees” will not be approved. Elaborate on this, for example: “Texting will be used internally and externally for more casual conversation. This includes topics such as follow-ups on recent email or phone conversations, meetings, conversational small talk, and confirming whereabouts or schedules. While typically initiated by the customer, employees may initiate for circumstantial reasons if given permission by the customer.”

Customer Prompts (Opt-in and opt-out instructions):

XBert Tip: An opt-in is when you ask a customer if you can message them, and they say yes. Even when a customer agrees to let you message them with an opt-in, they can always change their mind, and you need to make it easy for them to do so.

 

Subscriber Opt-In Message:

  • Keyword: START

     

  • Message Content: "You have successfully been subscribed to messages from [BRAND NAME] at this number. Message frequency may vary. Message and Data Rates may apply. Reply HELP for further assistance. Reply STOP to unsubscribe."

     

Subscriber Help Message:

  • Keyword: HELP

     

  • Message Content: "For additional information, please call [BRAND NAME] at [Support Number]. To opt out, reply STOP."

     

Subscriber Opt-Out Message:

  • Keyword: STOP

     

  • Message Content: "You have now been opted out and will receive no further messages from [BRAND NAME] at this number. Reply START to resubscribe."

     

Message Contents:

  • Embedded Link: Yes or No

     

    • Criteria: Selecting Yes indicates the campaign will send embedded links in the messages.

       

    • Action: If selected "Yes", an embedded link must be included in at least one of the sample messages. 

       

  • Embedded Phone number: Yes or No

     

    • Criteria: Only applies if you will be sending embedded phone numbers in the messages (excluding providing contact for HELP in help response).

       

    • Action: If checked "Yes", an embedded phone number must be included in at least one of the sample messages.

       

  • Direct Lending/Loan Arrangement: Yes or No

     

    • Criteria: Only applies if your company offers loans or any form of direct lending.

       

    • Action: Confirm that the Direct Lending or Loan Arrangement option is selected as Yes under "Campaign and Content Attributes."

       

  • Age-Gated Content: Yes or No

     

    • Criteria: Only applies if you will be sending age-gated content:

       

    • Action: Must be checked "Yes" if the content includes any age-gated materials.

       

Sample Messages:

You will need to provide at least two real examples of messages that will be sent out to customers or for internal purposes. Include the brand name and a brief message of opt-out. These messages give a clear idea of the message content and format, helping to ensure compliance with SMS guidelines.

 

Example Messages:

  • "Thank you for reaching out to BRAND. We appreciate your interest! Expect to hear from us shortly. Reply STOP to opt-out of future messages."

     

  • "Thank you for choosing BRAND! We see you are interested in our SERVICES/PRODUCT. If you want we can schedule a call or a visit. You can reply STOP at any time to opt-out."

     

Privacy Policy:

Required: the privacy policy must be placed at the footer or the header of the webpage. This button should link to a dedicated page with an extensive privacy policy. The privacy policy must include a “do not share” statement that reads: 

 

"No mobile or messaging consent information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties."

SMS Terms and Conditions:

By opting in to receive SMS messages, you agree to the following: receive SMS messages from [Business Name] to provide updates and important information. Message frequency may vary, and message and data rates may apply. You can opt out anytime by replying STOP. For help or more information, reply HELP.

- **Opt-In** – Consent is obtained before sending messages. Subscribers will receive a confirmation message upon opting in:

  "You have successfully been subscribed to messages from [Business Name] from this number. Message frequency may vary. Message and Data Rates may apply. Reply HELP for help. Reply STOP to unsubscribe."

- **Opt-Out** – Reply STOP at any time to unsubscribe. You will receive a confirmation message:

  "You have now been opted-out and will receive no further messages from [Business Name] from this number. Reply START to resubscribe."

- **Help** – Reply HELP for assistance. You will receive:

  "For additional information, please call [Business Name] at [Business support number]. To opt-out, reply STOP."

- **Privacy** – Your information is used only for the stated purposes. See our full Privacy Policy on our website.  [Privacy Policy Link]

Disallowed Content:

  • High-risk financial services (e.g., payday loans, short-term, high-interest loans, debt collection)

     

  • Get rich quick schemes (e.g., deceptive work-from-home programs, risk investment opportunities)

     

  • Debt forgiveness (e.g., debt consolidation, debt reduction)

     

  • Job postings (exceptions permitted if the message sender is the one doing the hiring)

     

  • Controlled substances (e.g., cannabis, CBD & hemp products, tobacco and vape)

     

  • Other disallowed use cases (e.g., phishing, pornography, profanity or hate speech, fraud or scam, deceptive marketing, lead generation, referral or reseller)

     

  • Shaft-C (sex, hate, alcohol, firearms, tobacco, cannabis/CBD)

     

XBert Tip: SMS is a highly regulated channel with strict rules, regulations, and carrier requirements. Certain message content is prohibited, and wireless carriers will automatically reject SMS and MMS messages containing such content. Additionally, some use cases require extra measures, such as age-gating procedures. If your business sends messages with any of the prohibited content listed above, SMS may not be the right channel to reach your customers.
